In his role as a Kentucky Supreme Court General/Civil and Family Mediator and Florida Supreme Court Certified Circuit Civil and Family Mediator, Mr. Shearer is a neutral and impartial third person, who facilitates the negotiations between the parties to enable them to accept a mutually accepted agreement, thereby resolving the dispute. He helps the parties communicate their different perspectives, discuss their needs and interests, and explore ways to resolve their conflict in a mutually acceptable way. The process is consensual; the parties are not required to resolve their dispute, and the mediator has no authority to determine the outcome.

Mr. Shearer believes that every case is unique and that the course of action should be tailored to address the specific situation. All parties should have the opportunity to actively participate in the design of their resolution process and should be completely comfortable and confident that a successful conclusion will be reached. Self-determination is critical throughout the resolution process. Parties should control the process and make their own decisions. Mr. Shearer will serve as a calm, unbiased, organized facilitator and will ensure complete confidentiality throughout the process. He also believes that the process should be convenient for all the parties and that the conferences should be scheduled with that in mind.

Mr. Shearer’s law practice spans a broad range and diverse group of people. He practiced in one or more levels of the Courts in 98 out of the 120 counties in Kentucky providing broad practical experience and exposure to a diverse number of Officers of the Court (judges and attorneys) and other parties.

Moreover, Mr. Shearer has creativity, ingenuity, and foresight, which lends toward his ability as a mediator. In the mid-1970’s, he took a leave of absence from the practice of law to co-found an alternative (synthetic) energy company utilizing a coal, oil and water mixture, treated ultrasonically for use as a substitute for industrial fuel oil. He served as its President and CEO until McDonnell Douglas Corporation (aerospace) acquired the company in 1980. The company’s innovative fuel – thirty (30) years ahead of its time – attained national and global recognition.
